1. Acceptance of Terms

By accessing or using BaseLeaf ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. We may update these terms from time to time, and continued use constitutes acceptance of any changes.

2. Description of Services

BaseLeaf is a technology platform that assists with immigration application preparation, including profile assessments, document organization, petition drafting, and USCIS form preparation.

All content generated through the Platform is provided as a starting point and should be reviewed carefully before use. Generated materials are not guaranteed to be error-free or suitable for filing without review.

3. Eligibility

You must be at least 18 years of age to use the Platform. By creating an account, you represent that you are at least 18 years old and that the information you provide is accurate and complete.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You agree to provide accurate, current, and complete information during registration and to update it as necessary.
• You must notify us immediately of any unauthorized use of your account.

5. User Responsibilities

When using the Platform, you agree to:

• Provide truthful and accurate information in all forms and documents.
• Not submit fraudulent, misleading, or false information.
• Not use the Platform for any unlawful purpose.
• Not attempt to access other users' data or accounts.
• Not reverse-engineer, decompile, or disassemble any part of the Platform.
• Comply with all applicable laws and regulations, including immigration laws.

6. Fees & Payments

• Evaluation: The initial profile assessment is provided free of charge.
• Petition Preparation: Paid services require payment before work begins. Current pricing is displayed at the time of purchase.
• Payment Processing: All payments are processed securely by Stripe. By making a payment, you also agree to Stripe's Terms of Service.
• Payment Plans: If you select a payment plan, you agree to pay all installments according to the agreed schedule. Failure to complete installment payments may result in suspension of services.

7. Refund Policy

• Refund requests made before any petition drafting work has begun will be honored in full.
• Once petition drafting has commenced, refunds will be evaluated on a case-by-case basis.
• The free profile assessment carries no financial obligation.

8. Intellectual Property

• The Platform, its design, code, and content are owned by BaseLeaf Inc. and protected by intellectual property laws.
• Documents generated for your petition (drafts, letters, forms) are prepared for your personal use in your immigration application.
• You retain ownership of all personal documents and information you upload to the Platform.
• You may not redistribute, resell, or commercially exploit any Platform-generated content.

9. Attorney Review

All petitions prepared through the Platform include review by a licensed immigration attorney. BaseLeaf facilitates the document preparation process and coordinates attorney review, but is not a law firm and does not itself provide legal advice.

10. No Guarantee of Outcome

BaseLeaf does not guarantee approval of any immigration petition, visa application, or benefit request. Immigration decisions are made solely by USCIS and other government agencies. Our services are designed to help you prepare the strongest possible application, but the outcome is ultimately determined by the adjudicating authority.

11. Limitation of Liability

To the maximum extent permitted by law:

• BaseLeaf is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform.
• Our total liability for any claim related to the Platform shall not exceed the amount you paid to BaseLeaf in the 12 months preceding the claim.
• We are not liable for delays or failures in service caused by circumstances beyond our reasonable control.
• We are not responsible for immigration petition outcomes, government processing times, or changes in immigration law.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

13. Termination

• You may close your account at any time by contacting us.
• We may suspend or terminate your account if you violate these terms or engage in fraudulent activity.
• Upon termination, your right to use the Platform ceases. Data retention is governed by our Privacy Policy.
